Terms of Service

These Terms of Service ("Terms") govern your use of TapClara (the "Service") provided by Curious Ventures LLC ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

Payments: Payments for subscriptions are processed by Paddle as Merchant of Record. This means Paddle handles checkout, billing, tax collection, and invoicing for subscription purchases. Your purchase may also be subject to Paddle's terms and privacy policy, in addition to these Terms.

Accounts & Eligibility

You must be at least 13 years old to use the Service. If you are a resident of the European Economic Area (EEA), you must be at least 16 years old, or the applicable age of digital consent in your country, to create an account. By creating an account, you represent and warrant that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account and for all activity under it. We reserve the right to suspend or terminate your account at any time, without notice or liability, for any reason, including if you breach these Terms. We may also limit, suspend, or revoke access to particular features, including AI generation, where reasonably necessary to investigate misuse, enforce these Terms, protect the Service, protect other users, or comply with applicable law or third-party platform and provider requirements.

Acceptable Use

You agree not to misuse the Service, including attempting to access systems without authorization, reverse engineering the Service except where permitted by law, or using the Service for unlawful purposes.

In particular, you agree not to use the Service or its AI generation features to submit, request, generate, or attempt to generate content that is unlawful, abusive, harassing, hateful, sexually explicit, violent, fraudulent, infringing, or otherwise prohibited by these Terms, applicable law, or the policies of our third-party providers. You also agree not to probe, test, evade, reverse engineer, or bypass safety filters, moderation systems, rate limits, access controls, or other protective measures, and not to use automated means to generate excessive, abusive, or manipulative requests.

Subscriptions

Subscription options and features are described on our Pricing page. You may cancel your subscription at any time to prevent future billing. If you cancel, access continues until the end of your current billing period.

AI-Generated Content

The phrases and translations provided by the Service are generated using artificial intelligence (AI). While we strive for accuracy, AI-generated content may contain errors or inaccuracies. TapClara does not guarantee the accuracy, completeness, or usefulness of any AI-generated content. You are solely responsible for any actions you take based on the AI-generated content and should not rely on it for critical decisions without independent verification. You acknowledge that the underlying AI models are constantly evolving, which may lead to changes in the nature, style, or accuracy of the generated content over time. Content generated by the Service is provided for your personal, non-commercial use within the TapClara application only. Reproducing, distributing, or using this AI-generated content for other commercial purposes is prohibited without our prior written consent. You acknowledge that you use such content at your own risk. AI generation features may be limited, filtered, delayed, blocked, or unavailable at any time based on our internal safety systems, operational needs, or the rules and moderation decisions of our third-party AI providers.

AI Enforcement

If we determine, or reasonably suspect, that your use of the Service or its AI features violates these Terms, applicable law, or third-party provider rules, we may reject requests, remove generated output, rate limit usage, apply warnings or strikes, temporarily suspend or permanently revoke AI-generation privileges, or suspend or terminate your account. We may take these actions with or without prior notice where reasonably necessary to protect the Service, our users, or our service providers.

Safety enforcement may apply even where a request is phrased indirectly, uses euphemisms, asks for a translation of an abusive or discriminatory opinion, or attempts to probe or evade moderation rules. Repeated policy-violating prompts may trigger escalating consequences, including strike accumulation, temporary AI-generation suspension, private-only treatment of future generated cards, hiding or quarantining previously published cards from public discovery surfaces, reporting or feature restrictions, and permanent loss of access to AI generation.

Content you generate or publish through the Service is not guaranteed to remain publicly visible. We may hide, de-rank, quarantine, remove, or otherwise restrict access to generated content where reasonably necessary for safety, quality, provider-policy compliance, abuse prevention, moderation review, or legal compliance. Abuse of community reporting or moderation systems may also result in reporting restrictions or other account-level enforcement.

Except where required by applicable law, and subject to Paddle's role as Merchant of Record and our Refund Policy, blocked, rejected, or policy-violating AI requests may still count toward usage limits, credits, or feature entitlements and do not automatically entitle you to a refund, restoration of credits, or other compensation.

Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Curious Ventures LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Limitation of Liability

In no event shall Curious Ventures LLC, nor its members, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
